EVICTION CHECKLIST AND FORMS

Getting Started on Your Eviction


There are a few documents you will need to begin the eviction process. Prior to filing for an eviction, you must post a Three Day Notice to your tenant outlining the reason for eviction and the date by which full compliance is required. Once the Three Day Notice has been posted and three days (excluding weekends and holidays) has lapsed without full compliance being met, you can start the eviction filings. Below is what our office will need from you to handle your eviction:


  1. Three Day Notice must be posted at least three working days prior to filing.
  2. Fax, mail, or email a copy of your three-day notice, lease, and a break down of the charges listed on the three-day notice. Be sure to include a cover sheet with your contact information.
  3. We will then contact you regarding payment. (Payment options include: Check, Cash, Money Order, or PAYPAL®. Any applicable PAYPAL® fees are the responsibility of the client. Payment is to be made to the Law Office of John Schwartz).
  4. Once payment is received, we will start the eviction process.
  5. If your tenant has not vacated or responded to the eviction notice within 5 business days after it has been served or posted, an additional Sheriff's fee will apply (typically $90; price may vary by county).
  6. The Sheriff or our office will then notify you when you can take possession of the residence.
